The three neighbourhood forums in Torbay (Torquay, Paignton and Brixham Peninsula) have applied to renew their status as “Qualifying Bodies” (i.e. Neighbourhood Forums) and their associated Neighbourhood Area.

Views are sought on the applications for forum designation and neighbourhood areas.  The consultation will be available from noon on Friday 6 October and representations must be received by 23:59 on Monday 20 November 2017.  We would prefer that they are emailed to Alternatively they can be posted to Forum Renewal, Spatial Planning, Electric House, Castle Circus, Torquay, TQ1 3DR.

It would be helpful if any representations are clearly marked “neighbourhood forum designation” and the specific Forum (i.e. Torquay, Paignton or Brixham Peninsula) identified.

This consultation is about the forums’ status and the area to which they relate. It is not a consultation on the neighbourhood plans. Such a consultation will follow shortly on each of the three plans.

Please note: when forums are designated, no other organisation may be designated in that neighbourhood area until that designation expires or is withdrawn.

Background Information

Since 6th December 2012, Torbay has had three neighbourhood forums, one each for Torquay, Paignton and Brixham Peninsula (which includes Brixham, Churston, Galmpton and Broadsands). The forums were designated by full Council and the designation lasts for 5 years (i.e. to 7th December 2017).  For this reason the same forums have applied to renew their status.

Neighbourhood forums are empowered to prepare neighbourhood development plans, local development orders and to comment on planning applications. Their primary role in Torbay is to prepare neighbourhood plans. Paignton and Brixham have submitted their plans to Torbay Council for publication and examination. Submission of the Torquay Neighbourhood Plan is expected in Autumn 2017.   These plans will be the subject of a separate consultation.

Neighbourhood forums were created by the Localism Act 2011.  Schedule 9 Section 61F sets out requirements for the designation of forums (which the legislation refers to as “qualifying bodies”). The Neighbourhood Planning Act 2017 also contains legislation on neighbourhood plans.

The Neighbourhood Planning (General) Regulations 2012 (as amended) sets out detailed requirements for neighbourhood planning.  Regulations 5 to 11 deal with forum designation. This consultation is made under Regulation 9.
