Scaffolding and Hoarding Licence


To put up Scaffolding or to erect a hoarding on the public carriageway or footway without first applying for and being granted a license is an offence under The Highways Act 1980 (section 169) and may result in a prosecution.

Licence Applications

Scaffolding companies wishing to erect scaffolding must apply for a permit, you can complete the application form and post back to us with your payment and copy of your Public Liability Insurance (The minimum level of such insurance shall be £5,000,000 but it shall remain the responsibility of the applicant having taken any necessary professional advise to determine the appropriate level of cover).

Application Notice Period

3 types of application can be applied for:
  1. Major Works, where a licence period of between 10 and 28 days is required. These applications must be made 3 months in advance of the start date. Renewals of Major Works licences must be applied for giving 10 days notice and will be for a maximum of 28 days.
  2. Standard Works, for a maximum licence period of 10 days. Applications or renewals made with less than 10 days notice will attract enhanced charges.
  3. Emergency Works, for a maximum licence period of 10 days but enhanced charges will apply.

The cost will vary subject to notice given and if a site visit is required. The charges are revised each year and will be posted here:

Failed Application/Licence Holder Redress

Please contact Torbay Council in the first instance. If you wish to appeal against a decision you may do so to the local Magistrates' court.

Cancelled Licenses

Where the applicant withdraws a licence application, fees will still be payable if Torbay Council has completed the administration of the application.

Any complaints about the location or safety of scaffolding should be reported instantly using the contact details above and one of our inspectors will go to the site to assess the safety and this will be dealt with accordingly.
